An example of the so called "conservative" media avoidance of the issue is this from James Taranto (WSJ Online) yesterday titled <A HREF="http://online.wsj.com/article/SB122763857669957141.html" REL="nofollow"> "Natural Born Baloney"</A> in which he attempts to debunk the "urban legend" about the possible SCOTUS hearing. He concludes with; <I>"One Leo Denofrio has a pending petition for certiorari in a similar case that was dismissed by the New Jersey Supreme Court. His prospects for success are approximately equal to Berg's, for the same reasons.
