The prevarication is ironic given the Obama campaign’s accusations that the Bush years were not transparent and that Hillary Clinton, like her husband, was a chronic fabricator. Remember Obama’s own assertions that he was a “student of history” and that “words mean something.

Here is another thing to consider. The COLB that Obama offers as his proof (and has been deemed unreliable) just showed up without explanation. There is nothing from the State of Hawaii about Obama requesting a copy of his BC. Obama, nor the DNC has come forward with evidence of a request for the copy so where did it come from? These cost $10 to get and if requested via the phone would have had to use a credit card or sent a check or money order by mail, yet, nothing is, or ever has been, offered as proof of even a request for the copy. Someone could have said here is a CC receipt, or a canceled check, or the remitters copy of a MO.

Someone should have this without a doubt.

Given the significant increase in warnings and delusional, irrational, obscene, threatening comments from Obama supporters I would conclude that they think the Grand Jury tactic is a real threat.

Note to Birfers Crowing About Texas Grand Jury

Call District Clerk of Lavaca County Calvin Albrecht and ask him about it. He says the clerk who accepted the "presentment" had only been on the job two months, and made a mistake by accepting it. He says the District Attorney of Lavaca County, Heather Hollub and the Texas Attorney General are aware of the "presentment," and that it may violate the Texas law against phony legal documents. Whoever "filed" it may face criminal charges in the near future.

Better luck next time, genius.

What really happened:

Today I returned to the Lavaca County, Texas, court clerk's office to get a certified copy of the presentment I'd filed Monday, for purposes of contacting the County Attorney to get the ball rolling on an indictment.

The clerk, whom I'd not met, came in with my presentment in hand, and in a barely civil manner asked what "this" was. I told him, whereupon he pointed to a notice on the wall which read "It is a crime to file a fraudulent document with this court," and told me that's just what I had done, according to "the judge."

I told him about the mention of the citizen's grand jury in the Bill of Rights, and about how in 1946 during revision of some court laws/regulations the word "obsolete" had been used and subsequently connoted to mean illegal, and about how in 1992 (quoted USA vs. Williams) Justice Scalia had reaffirmed the viability of the citizens' grand jury as historically legal, appropriate, intentionally separate from the court's jurisdiction and control, and finally that he said it was the buffer between the government and the people, as the Fourth (and senior) Branch of Government, as defined, "We The People."

Glad I remembered all that, because he calmed down a little, told the assistant to give me a certified copy, and wished me luck in our endeavor...
said "Between you and me, that's how I feel, too."

So. I'm writing only you about this incident, and suggesting that if you
think it's a good idea to publicize the incident, do so, with the accompanying suggestion that people take along with a presentment to be filed a copy of Leo Donofrio's article, "The Federal Grand Jury Is The Fourth Branch" to help their cause (or at least keep their picture from being posted on the post office wall !).

This afternoon I'm going to give the clerk a copy to settle his bowels further.

Well I guess you folks could always argue that anyone who believes Obama is not constitutionally eligible to be POTUS is not a credible person.

Before you post another one of your irrational rants full of ridicule and name calling it is only fair to point out that some of the persons serving on the Lone Star Grand Jury are also members of more a conventionally empanelled Grand Jury.

“The grand jury shall inquire into all offenses liable to indictment of which any member may have knowledge, or of which they shall be informed by the attorney representing the State, or any other credible person.”

In Texas the Grand Jury is required by law to “inquire into all offenses” called to its attention.

We Will Not be Silenced -- A Documentary by Gigi Gaston

As Americans, we expect certain liberties and rights that were granted us by our forefathers, who wrote documents like the Constitution and the Declaration of Independence. "We the people" expect that these fundamental rights will always be protected. However, in the current Democratic Presidential Primary, this has not been the case. We believe that the The Democratic National Committee (DNC) made a grave error by depriving American voters of their choice of Hillary Clinton as Democratic nominee. As no court was ever been notified that a crime had been committed, the prosecutor had a clear duty to take a criminal complaint from the foreman of the grand jury, some grand jury member, or any other credible person having knowledge or reason to believe a crime had been committed.
Texas Code of Criminal Procedure Article 20.09. [381] [432] [420] Duties of grandJury

The grand jury shall inquire into all offenses liable to indictment of which any member may have knowledge, or of which they shall be informed by the attorney representing the State, or any other credible person.

While the grand jury is given the authority to act as criminal investigators, nothing extends that permission to acting against a person absent a proper criminal accusation. While a prosecuting attorney is specifically forbidden to swear out a criminal complaint, nothing so restricts a grand jury member. Like any other criminal investigator, if a grand jury member comes to knowledge that some person has committed a criminal act, that member has the same civic duty any other citizen has to report the crime by verified affidavit such that the accused may brought before some magistrate and the allegation examined in accordance with practices, procedures, and protections contained in Chapter 16 Code of Criminal Procedure.

It was also the duty of the prosecuting attorney, upon being made known in any manner that a public official had violated a law relating to his office, to prepare a complaint, have it sworn to by the foreman of the grand jury, a grand jury member, or any credible person having knowledge or reason to believe a crime had been committed by the accused.

According to Article 20.09 of the Texas Code of Criminal Procedure, a grand jury "shall inquire into all offenses liable to indictment of which any member may have knowledge, or of which they shall be informed by the attorney representing the State, or any other credible person."

Attorney General Opinions H-439 (1974); WW-1086 (1961). It is the duty of the grand jury to “inquire into all offenses liable to indictment of which any member may have knowledge, or of which they shall be informed by the attorney representing the State, or any other credible person.”

Article 20.09 of the code states: “The grand jury shall inquire into all offenses liable to indictment … of which they shall be informed by the attorney representing the State, or any other credible person.”
