Gun Rights Advocates Say Proposed Lead Ammo Ban Part of Larger Anti-Hunting Agenda

The goal of a proposed federal rule to ban lead ammunition from National Wildlife Refuges has nothing to do with protecting wildlife, Second Amendment advocates say.

“This is a way to price outdoorsmen and women off public lands,” Mark Oliva, managing director for public affairs of the National Shooting Sports Foundation (NSSF), the trade association for the firearms industry, told The Epoch Times.

The rule proposed by the U.S. Fish and Wildlife Service (FWS) on June 22, 2023, would open three National Wildlife Refuges (NWR), drawing praise from the gun groups.

However, the rule would also prohibit using lead shot and lead fishing tackle in eight NWRs in five states.

They are the Blackwater NWR and Patuxent Research Refuge in Maryland, the Chincoteague, Eastern Neck, Wallops Island NWRs in Virginia, the Erie NWR in Pennsylvania, the Great Thicket NWR in Massachusetts, and the Rachel Carson NWR in Maine.

According to the FWS, the move is to protect wildlife from lead poisoning. But a wildlife biologist and gun rights advocate says the FWS rule is based on politics, not solid research.

“It is not based on science. I believe this is designed to drive up ammunition costs to discourage hunting,” Mark Jones, the National Director for Hunter Outreach for Gun Owners of America and a wildlife biologist with 20 years of experience, told The Epoch Times.

“I believe that’s the goal of many people.”

The FWS did not respond to The Epoch Times's requests for comment.

According to the FWS website, the rule, “National Wildlife Refuge System: 2023-2024 Station-Specific Hunting and Sport Fishing Regulations” is intended to protect wildlife from lead poisoning.

The FWS states that it used “the best available science” to write the rule. According to the website (pdf), wildlife is exposed to lead in many ways. This includes ingesting lead fishing tackle or residual lead shot left by hunters, or eating carrion that contains lead shot. They can also ingest soluble lead in water, soil, and manmade sources such as lead-based paint chips.

Mr. Jones said much of the data presented comes from studies of the California Condor. According to the FWS, (pdf), between 1990 and 2020, approximately half of the 213 condors that died from a known cause were killed by lead poisoning. But Mr. Jones said the California Condor is not typical of the animals found in a NWR.

“Condors are getting access to lead from sources other than ammunition,” he said.

NSSF officials agree with Mr. Jones’s assessment.

In an Aug. 20, 2023, letter to the FWS, an NSSF official wrote that the available scientific studies do not support FWS claims that lead is a widespread danger to wildlife.

“Decades of significant research exist on lead and wildlife. It is grossly misleading to insinuate that lead ammunition poses a danger to ‘wildlife’ as a whole,” wrote Lawrence G. Keane, Senior Vice President for Government Affairs, assistant secretary, and general counsel for the NSSF.

“The science does not support this claim.”

According to the letter, the FWS cites studies that use “cherry-picked samples of venison X-rayed by a veterinarian” as evidence of lead contamination in wildlife. But those studies don’t clearly link the supposed lead and any alleged poisoning. Mr. Keane wrote that the objects in the X-rays could have been something other than lead.

“No clear indication was made, only blame assigned. Reliance on this editorial and study is misplaced,” he wrote.

Mr. Keane said studies by the Centers for Disease Control and Prevention of hunters in North Dakota showed no evidence of elevated levels of lead in the blood of people who regularly consumed wild game.

This is not the first time lead shot has been an issue. Lead shot was banned from waterfowl hunting in 1991. For years, ducks, coots, and other waterfowl were suspected of dying from lead poisoning.

Mr. Jones said that, in time, it became clear that was the case.

He said that, unlike raptors, ducks must ingest gravel so their gizzards can grind up their food. According to Mr. Jones, the waterfowl would scoop up residual lead shot from the soil where hunters had been shooting.

Other animals don’t need to swallow gravel, so they will not likely ingest lead in this way.

“A deer isn’t going to paw the ground and dig up spent slugs and swallow them," he said. "Those are two very, very different situations.”

Mr. Oliva said the true objective has nothing to do with saving wildlife.

“This is a way to price outdoorsmen and women off the public lands,” he said.

Mr. Oliva said the rule will force hunters to turn to lead-free alternatives that are expensive and difficult to find.

He said up to 95 percent of all ammunition uses lead, with only 5 to 10 percent of commercially produced ammunition comprising non-lead components. Compounding the problem is that only about 1 percent of the alternative ammunition is centerfire rifle ammunition used in big game hunting.

Alternatives Are Scarce, Expensive

“Forcing all hunters on NWR land to only use alternative non-lead ammunition puts a large strain on the supply of that ammunition,” Mr. Keane’s letter reads.

Mr. Jones pointed out that the majority of hunters depend on public land. Both men said the rule appears to be part of a plan by anti-hunting and anti-gun forces. They pointed out that the Obama administration had banned lead ammunition on all public lands the day before President Donald Trump took office.

President Trump’s first Secretary of the Interior, Ryan Zinke, rescinded that order as his first act.

Mr. Oliva and Mr. Jones say this rule is part of a plan to stop hunting on public lands.

“This [step] is more insidious. They will expand it to more and more areas,” Mr. Jones said.

Mr. Oliva pointed out that the rule has not yet been set. The public comment period ended on Aug. 22. Now, the FWS will consider the public comments and determine what adjustments need to be made. He said Mr. Keane’s letter makes clear the NSSF’s position on the issue.

“[The FWS has] presented no site-specific, peer-reviewed evidence that traditional ammunition is causing any harm. They’re trying to ban traditional lead ammunition with no scientific evidence,” Mr. Oliva said.

Mr. Jones said that the public’s position on the rule should be clear by GOA's calculations. He noted that FWS had received 18,564 comments by the deadline. According to GOA records, 17,608 were from GOA members and supporters opposed to the rule.

“We know that at least 95 percent are opposed,” Mr. Jones said.

(Washington, DC) – Judicial Watch announced today that it received 18 pages of records through the Massachusetts Public Records Law from the Edgarton, MA, Police Department that show the Secret Service reported Obama’s Personal Chef Tafari Campbell missing and that the body was found using sonar.

The records also report that clothing was found separate from the body and that he was not wearing a life vest. Several other important details were redacted regarding the July 23, 2023, drowning on Martha’s Vinyard.  

The records, released yesterday, include a July 23 CAD (computer aided dispatch) Incident Report:

Secret Service Agent [redacted] adv swimmers unable to locate the party at this time. Party last scene [sic] wearing all black, on a paddle board, African American male.

Rev’vd a 911 call from the above noted RP [reporting person] who identified as a Secret Service member. RP is req [requesting] at least an ambulance response, unsure of the exact services needed.

RP advd best access is from the residence, they are deploying a rescue swimmer and a zodiac boat right now.

RP adv no lifevest was worn, they have recovered the paddle board and clothing. Still no contact with missing party. They still have a boat and rescue swimmers in the area. 

At 8:25 p.m., the report notes that the Oak Bluffs Fire Department was sending a dive team. At 8:36 p.m., a Coast guard helicopter was deployed, as was a state police helicopter.

In the reports sent by Polce Chief Bruce McNamee, the names of a witness and a Secret Service agent are removed. In his email transmitting the reports, McNamee writes: “Per the request of theMa State Police, the names of the witness and USSS agent have been redacted.”

The police and fire departments make their base of operations at Wilson’s Landing, a popular boat launch. Search and dive teams from Oak Bluffs, Tisbury and West Tisbury joined the search.  

The next day, Sgt. William Bishop writes:

Once on location [Wilson’s Landing] we established a command post. I requested through MSP a search helicopter, and Chief Schaeffer requested a USCG helicopter as well. Search & Dive teams from Edgartown, Oak Bluffs, Tisbury, West Tisbury responded via mutual aid. An extensive search began for several hours. A last known location was established, and Trooper Shaw of MSP also assisted with operations. 

I instructed Officer Guest and Officer Dacey to commence a shoreline search effort starting from the closest house and working outward. Both Officers checked every house with waterfront access in the search area. Unfortunately, the search did not yield and results. 

Both air wings conducted a search until their fuel supply forced a return to base.

At or about 11PM the dive and land search was suspended. Edgartown and Oak Bluffs Fire planned to continue a grid search by boat for the remainder of the night. At first light, dive team operations will continue. During the duration of this incident the entrance to Wilson’s Landing was closed as to give responders room to work.

The next morning the dive team search continued, and a deceased Mr. Campbell was located using sonar. The investigation will now be handled by Massachusetts State Police and The Cape and Islands District Attorney’s Office. No further action. 

“It is concerning that Judicial Watch had to push and push for information on this tragic death, such as the new revelation that the Obama’s Secret Service protection reported Mr. Campbell missing,” Judicial Watch President Tom Fitton said.

Arkansas Gov. Asa Hutchinson said Sunday he is weighing a presidential run in 2024 and his decision won't be affected by whether former President Donald Trump decides to join the race.

Hutchinson, a two-term Republican governor who is restricted under Arkansas law from seeking a third term, said it was time for the national GOP to move on from Trump in regards to the candidates he's endorsing in the 2022 midterm elections as well as "the direction he wants to take our country."

Asked on CNN's "State of the Union" if he was mulling a presidential run, Hutchinson replied: "I am. But you have got to get through, of course, this year, but that’s an option that’s on the table."

Making clear he was "not aligned" with Trump, Hutchinson added: "I think he did a lot of good things for our country, but we need to go a different direction. And so that’s not a factor in my decision-making process."

Currently the chairman of the National Governors Association, Hutchinson in recent months has become a fixture on cable television — at times drawing the ire of Trump — in defending his veto of legislation targeting transgender youths in the state and warning fellow Republicans about tying their fortunes too closely to the former president. After the Jan. 6, 2021, Capitol riot, which led to Trump’s impeachment by the House, Hutchinson said he wanted Trump’s administration to end. He's made it clear since early 2021 that he would not back a Trump 2024 bid and urged public officials to look ahead rather than focus on Trump's false claims of a stolen 2020 election.

Though Trump remains the most popular figure among Republican voters who dominate primary elections, several GOP figures are considering presidential runs on a platform opposing the former president. Beyond Hutchinson, they include Gov. Larry Hogan of Maryland and Reps. Adam Kinzinger of Illinois and Liz Cheney of Wyoming.

Other candidates eyeing possible runs are Florida Gov. Ron DeSantis, former Vice President Mike Pence and former Secretary of State Mike Pompeo, though they have been less clear about their intentions if Trump enters the race. Nikki Haley, a former South Carolina governor and U.N. ambassador, has said she would stand down on a potential bid if Trump opts to run a second time.

WASHINGTON, Aug. 17, 2023 — The American Bar Association condemns the unauthorized disclosure of the private and personal data of the grand jurors in the Fulton County, Georgia, case against Donald Trump.

Georgia state law, with the goal of transparency, requires the names of grand jurors to be listed in an indictment, even in high-profile cases. While the public release of the information is not illegal in Georgia, it is against the law to harass, stalk and threaten.

The American jury has played a crucial part in our democracy for more than 200 years and juror participation in the process is essential to the successful functioning of our judicial system. The civic-minded members of the Georgia grand jury performed their duty to support our democracy. It is unconscionable that their lives should be upended and safety threatened for being good citizens.

The ABA calls on all political and governmental leaders to denounce this activity and for law enforcement to investigate fully any threats to the innocent people involved.

Fulton County District Attorney Fani Willis might have been pressured by Washington to push through the racketeering indictment against former President Donald Trump and his 18 allies, according to former House Speaker Newt Gingrich.

"I am told by a reliable source that Friday evening somebody from Washington called the district attorney in Atlanta and said, 'You have to indict on Monday,'" Gingrich told Turning Point USA founder Charlie Kirk on Thursday morning.

The call came after Attorney General Merrick Garland was effectively forced to go back on his vow and grant U.S. District Attorney David Weiss in Delaware special counsel authority for investigating Hunter Biden, according to Gingrich.

"'We have to cover up all the mistakes we just made with Weiss,'" Gingrich continued. "And she said, apparently, 'My jurors aren't coming back until Tuesday.'

"They said, 'You didn't hear me: You have to indict on Monday.'

"And she said, 'Well, they're not going to get here before noon.'"

Those instructions, allegedly designed as a public distraction or media diversion according to Gingrich, were potentially the cause of Willis' mistakes, including "accidental" leaking of the grand jury court docket online that outlined the charges to be brought before the grand jury.

They also caused the late-night vote and indictment, according to Gingrich.

"'It doesn't matter: We need the news media shifting off of Weiss,'" he added, quoting what he was told was said.

Gingrich admits his revelations are "hearsay" and thay he does not know who made the order to Willis, "but it's from a person who has remarkably good sources," he said in the interview posted on social media Thursday.

2020 election influence investigation

On February 10, 2021, Willis launched a criminal investigation into Donald Trump's attempts to influence Georgia election officials—including the governor, the attorney general, and Secretary of State Brad Raffensperger via a telephone call—to "find" enough votes to override Joe Biden's win in that state and thus undo Biden's victory in the 2020 presidential election.[11][12][13]

In January 2022, she requested a special grand jury to consider charges of election interference by Trump and his allies.[14][15] In May, a 26-member special grand jury was given investigative authority and subpoena power and tasked with submitting a report to the judge and Willis on whether a crime was committed.[16]

Willis sent target letters to people she is investigating related to the fake electors plot. These include two Republican officials—State Senator Brandon Beach and David Shafer, chairman of the Georgia Republican Party[17]—and the 16 people who falsely presented themselves as electors.[18] She also sent a target letter to State Senator Burt Jones, but then a judge said she could not target Jones due to a conflict of interest.[19]

After hearing from 75 witnesses—including former US Senator Kelly Loeffler, former White House Counsel Pat Cipollone,[20] and possibly Sidney Powell[21]—the special grand jury completed its work and was dissolved on January 9, 2023. On February 16, following a judge's order, parts of the report were released.[22] The judge did not permit the release of recommendations for possible charges,[23][24][25] intending to preserve the "due process" for anyone who might be indicted later.[26] Several days later, the foreperson of the grand jury hinted that the recommendations were not "some giant plot twist" and that no one would be "surprised".[27]

On April 24, 2023, Willis announced she would announce decisions to charge Trump and his associates during the Georgia Superior Courts' fourth term, perhaps as soon as July or August 2023.[28] Willis's office indicted Trump and 18 others on 41 charges on August 14, 2023.

Early life

Willis was born in Inglewood, California. Her father was a member of the Black Panthers and a criminal defense attorney.[5] When Willis was in the first grade, her family moved to Washington, D.C. Her parents divorced, and her mother eventually moved back to California. Willis mostly stayed with her father.[1] Willis studied political science at Howard University, graduating cum laude in 1993, then moved to Atlanta[1] to attend Emory University School of Law, graduating in 1996 with a Juris Doctor.[4]

She spent 16 years as a prosecutor in the Fulton County district attorney's office. Her most prominent case was her prosecution of the Atlanta Public Schools cheating scandal. Willis, an assistant district attorney at the time, served as lead prosecutor in the 2014 to 2015 trial of twelve educators accused of correcting answers entered by students to inflate the scores of state administered standardized tests. Eleven of the twelve were convicted of racketeering under Georgia's RICO statute in April 2015.[6]

In 2018, she went into private practice.[7] That year, she ran for a seat on the Fulton County Superior Court, and lost.[8] In 2019, Willis became chief municipal judge for South Fulton, Georgia.
