Two of
the nation's largest teachers unions and Microsoft on Wednesday announced a
legally enforceable national standard governing how artificial intelligence
tools handle student and teacher data, saying they acted because federal
regulators have not.
The National AI Safety & Privacy
Standard, negotiated by the American Federation of
Teachers, the United Federation of Teachers and
Microsoft, allows school districts to write the
protections directly into their Microsoft contracts.
AFT President Randi
Weingarten and Microsoft Vice Chair and President Brad
Smith signed the memorandum of agreement Monday.
"We have forged a hard-fought, iron-clad
privacy agreement with real teeth that protects students and families, because
no one else, including the federal government, has stepped up to do the real
work," Weingarten said in a statement. "We can get angrier and
angrier, or we can act decisively; anything less than legally enforceable
provisions is simply a wish list."
Under the standard, student and educator data
cannot be used to
train AI models, sold or repurposed, and districts retain control over how long
data is kept and when it is deleted.
AI
systems covered by the agreement cannot make decisions about students without
human oversight and must avoid manipulative or harmful interactions. Companies
must disclose product changes, risks and available controls, and provide
parents and educators plain-language explanations of the tools.
The
unions said the agreement's enforcement provisions distinguish it from
voluntary industry pledges. Districts may terminate contracts and seek damages
from providers that violate the terms. If a material breach goes uncured, the
AFT or its National Academy for AI Instruction may revoke a provider's
participation and announce the revocation publicly.
"This
standard sets a high bar for child privacy and AI safety, and we'll extend this
agreement to every school district across the country," Smith said in a
statement.
Michael
Mulgrew, president of the 200,000-member United Federation of Teachers, said
the agreement begins to level the playing field in a "competitive,
ever-changing arena" that lacks guardrails for children and school
communities.
"Educators
are stepping in to do what we do best: protect our students," Mulgrew said
in a statement.
"This
agreement gives families and school districts the information and privacy
protections they have been demanding, and it empowers school districts to end
agreements and seek damages from bad actors who break the rules."
Microsoft
will make the protections available to all U.S. school districts beginning Nov.
1 without requiring them to renegotiate existing contracts. The framework
leaves open slots for other AI companies to sign on.
The AFT
launched the National Academy for AI Instruction in 2025 with Microsoft, OpenAI
and Anthropic to train teachers on classroom AI use. New York City Public
Schools and the Los Angeles Unified School District have adopted similar frameworks.
