Sen. Dianne Feinstein Dies at 90

Sen. Feinstein was the oldest member of Congress.

The oldest member of Congress has died.

Sen. Dianne Feinstein (D-Calif.) passed away at age 90 during the evening of Sept. 28, her chief of staff said Friday.

Her cause of death has not been made public.

"Her passing is a great loss for so many, from those who loved and cared for her to the people of California that she dedicated her life to serving," James Sauls, the chief of staff, said in a statement.

"She left a legacy that is undeniable and extraordinary. There is much to say about who she was and what she did, but for now, we are going to grieve the passing of our beloved boss, mentor and friend," Mr. Sauls added.

Ms. Feinstein became a U.S. senator in 1992. She was reelected five times. Before her time in Washington, she was San Francisco's mayor and a member of the city's Board of Supervisors.

Ms. Feinstein's latest husband, Richard Blum, died in 2022.

Ms. Feinstein had been struggling with health issues. She was briefly hospitalized in August after a fall. She was cared for in a hospital for months after contracting shingles in March. Complications from the infection included Ramsay Hunt Syndrome, which can cause facial paralysis. When she returned to the Senate, she was being pushed around in a wheelchair.

Ms. Feinstein had handed over power of attorney to her daughter as part of a battle over Mr. Blum's estate.

Seat to be Filled by Governor

The seat held by Ms. Feinstein will be temporarily filled by a person chosen by California Gov. Gavin Newsom, a Democrat.

Under the U.S. Constitution, states have the power to fill vacancies that arise in the Senate.

Mr. Newsom has not said when he will make his choice. In a statement on Friday, he said Ms. Feinstein was "a dear friend, a lifelong mentor, and a role model not only for me, but to my wife and daughters for what a powerful, effective leader looks like."

Mr. Newsom has previously said he would appoint a black woman if a Senate vacancy arose but clarified in September he would not appoint any of candidates running for the seat.

"I don't want to get involved in the primary," he said.

Ms. Feinstein's seat was already set to become vacant in early 2025, as she had opted not to run for another term.

The race for the seat includes U.S. Reps. Barbara Lee (D-Calif.), Katie Porter (D-Calif.), and Adam Schiff (D-Calif.). Republicans running include attorney Eric Early and businesswoman Sarah Sun Liew.

No Republican has represented California in the Senate since 1992.

Democrats currently hold a majority in the Senate. With Feinstein, that majority was 51–49. Without her, it is 50–49.

Congress is working on passing a new budget as a government shutdown looms.

History in Congress

Ms. Feinstein was praised Friday by colleagues on both sides of the aisle.

"Dianne Feinstein was a treasured friend to the Wyden family. She was an extraordinary advocate for San Francisco, for California, and for the West," Sen. Ron Wyden (R-Ore.) said in a statement.

"Sen Feinstein did an outstanding job representing the people of California," Sen. Chuck Grassley (R-Iowa) added.

Ms. Feinstein helped craft a federal ban on some guns that was in place from 1994 to 2004.

She said her efforts to impose stricter regulations on gun ownership stemmed in part from the assassinations of San Francisco Mayor George Moscone and Supervisor Harvey Milk. Ms. Feinstein became the city's mayor after Mr. Moscone was killed.

Ms. Feinstein rallied for approval of new gun control laws after the 2012 mass killing of people at Sandy Hook Elementary School in Connecticut in 2012.

In Washington in 2021, Ms. Feinstein described America as "a gun-happy nation, and everybody can have their gun."

"Unfortunately we’re not making the laws that could protect people in this kind of gun crimes," she added, referring to a mass shooting in San Jose.

Ms. Feinstein was for years the chairwoman of the Senate Intelligence Committee. During her tenure, the panel reported on how the CIA ran secret detention facilities outside America and interrogated suspected terrorists in the wake of the Sept. 11, 2001, terror attacks on the United States. The report's summary said that the CIA's interrogation techniques in some cases "amount[ed] to torture." The actual report has remained classified.

"The CIA's actions are a stain on our values and our history," Ms. Feinstein said at the time.

The CIA said the report “provided an incomplete and selective picture of what happened.”

Ms. Feinstein was also a defender of the government's spying on Americans, after exposure of the spying by National Security Agency contractor Edward Snowden.

"It's called protecting America," Ms. Feinstein said after details of the spying programs were made public. Her position ran counter to that of many colleagues, Republican and Democrat.

Ms. Feinstein was also criticized by some colleagues and activists for her handling of confirmation hearings for President Donald Trump's three Supreme Court picks, especially when she embraced Senate Judiciary Chairman Lindsey Graham (R-S.C.) after confirmation hearings for Justice Amy Coney Barrett.

Ms. Feinstein shortly afterwards stepped down as the top Democrat of the Senate Judiciary Committee, without listing a reason. She remained a member.

Born on June 22, 1933, Ms. Feinstein graduated Stanford University in 1955 with a history degree.

She was married the following year but divorced her first husband, Jack Berman, in 1959, leaving her a single mother of her daughter, Katherine.

Ms. Feinstein, was appointed by California's governor to the California Women's Parole Board in 1960, starting her career in the government. She won a race for the San Francisco Board of Supervisors in 1960, and later became San Francisco's acting mayor following Mr. Moscone's assassination. She had previously lost two mayoral races.

Ms. Feinstein remarried in 1962. Bertram Feinstein, the second husband, died in 1978. Ms. Feinstein kept his name.

She married Mr. Blum, an investment banker, two years later.

In addition to her daughter, Ms. Feinstein leaves behind a granddaughter and three stepchildren.

On Oct. 4, you will hear your phone go off. Rather than receive a text from a loved one or co-worker, it will be a nationwide test ordered by the federal government.

That day, the Federal Emergency Management Agency and the Federal Communications Commission will partner to test the Emergency Alert System and Wireless Emergency Alerts on Americans’ phones across the country.

This two-part test is scheduled to begin at 2 p.m. EST, according to FEMA. The EAS test portion of the test will affect radios and televisions and last about a minute.

The message to accompany the test will say, “This is a nationwide test of the Emergency Alert System, issued by the Federal Emergency Management Agency, covering the United States from 14:20 to 14:50 hours ET. This is only a test. No action is required by the public.”

The test that will impact cell phone users will be the WEA test, the second time to be tested on phones but the third time in which the alert system has been tested. Phones will receive a text message displayed in either English or in Spanish, depending on the language settings of the wireless handset.

In its statement, FEMA said it and the FCC were “coordinating with EAS participants, wireless providers, emergency managers and other stakeholders in preparation for this national test to minimize confusion and to maximize the public safety value of the test.”

“The purpose of the Oct. 4 test is to ensure that the systems continue to be effective means of warning the public about emergencies, particularly those on the national level,” the statement read. “In case the Oct. 4 test is postponed due to widespread severe weather or other significant events, the back-up testing date is Oct. 11.”

Wireless cell phones should receive only one test text, with broadcast towers carrying out the tests for around 30 minutes. The message will read “THIS IS A TEST of the National Wireless Emergency Alert System. No action is needed.”

Phones set in Spanish will display “ESTA ES UNA PRUEBA del Sistema Nacional de Alerta de Emergencia. No se necesita acción.”

In order for the alerts to be accessible for everyone, including people with disabilities, alerts will include a unique tone and vibration, FEMA said. Your phone will sound even if it has alerts silenced, according to Parade.

Menendez Temporarily Steps Down as Foreign Relations Chair

U.S. Senator Bob Menendez, D-N.J., will temporarily step as chairman of the Foreign Relations Committee, following charges that he and his wife took bribes from three New Jersey businessmen, Senate Majority Leader Chuck Schumer, D-N.Y., said Friday.

In a statement, Schumer said that Menendez, who has not indicated that he would resign his Senate seat, has a right to due process and a fair trial. He said Menendez will step down "until the matter has been resolved."

The U.S. Attorney's office in Manhattan accused the defendants of accepting thousands of dollars in bribes in exchange for using Menendez's power and influence as New Jersey's senior senator to seek to protect and enrich the businessmen and benefit the government of Egypt.

Menendez has been an important ally to fellow Democrat President Joe Biden as he has sought to reassert U.S. influence on the world stage as Biden rallies support for congressional aid to Ukraine and Washington looks for ways to push back against a rising China.

West Point Military Academy Sued Over Race-Based Admissions

A conservative advocacy group has sued U.S. Military Academy at West Point, alleging its admissions policy is unconstitutional as its partly based on race.

A conservative advocacy group that won a Supreme Court case against race-based enrolment policies at Harvard is now suing the U.S. Military Academy at West Point, alleging that the academy's admissions policy is unconstitutional as it's partly based on race.

Students for Fair Admissions (SFFA) filed a complaint (pdf) on Sept. 19 at a federal court in New York, arguing that West Point uses race and ethnicity as factors in admissions, violating the Fifth Amendment's equal-protection principle.

The group wants the court to find the use of race in admissions at West Point unconstitutional and impose race-blind candidate evaluation procedures.

"West Point has no justification for using race-based admissions," the group wrote in the complaint. "Those admissions are unconstitutional for all other public institutions of higher education. The Academy is not exempt from the Constitution."

SFFA is the same group that won a case before the Supreme Court on June 29, reviving a strict interpretation of the 14th Amendment to make clear that equal treatment under the law bars discrimination based on race, even when that discrimination gives a leg up to groups considered "marginalized" or "underrepresented" in public life.

Heartened by its recent win against Harvard and the University of North Carolina, the group has set its sights on purging the U.S. military—and West Point—from what it sees as woke policies.

In its latest legal action, SFFA argued that, for most of its history, the West Point Academy evaluated cadets based on achievement and merit—but that has now changed.

“Instead of admitting future cadets based on objective metrics and leadership potential, West Point focuses on race,” the group wrote in the lawsuit.“In fact, it openly publishes its racial composition ‘goals,’ and its director of admissions brags that race is wholly determinative for hundreds if not thousands of applicants.”

But "America's enemies do not fight differently based on the race of the commanding officer opposing them" and "soldiers must follow orders without regard to the skin color of those giving them," the group added.

However, West Point sets benchmarks for the percentage of each class that should be filled by people of different races and ethnicities, and it "meticulously tracks its compliance with those figures down to a tenth of a percentage point," the group said.

West Point has nearly 4,400 undergraduates. Of these, 2,693 are white, 483 black or African American, 545 Hispanic/Latino, 414 Asian, and 38 American Indian or Alaska Native, according to October 2022 data from West Point (pdf).

SFFA wants the court to declare West Point's admissions policy unlawful and block it, arguing that the academy "discriminates based on race."

"Over the years, courts have been mindful of the military's unique role in our nation's life and the distinctive considerations that come with it. However, no level of deference justifies these polarizing and disliked racial classifications and preferences in admissions to West Point or any of our service academies," Edward Blum, president of SFFA, said in a statement.

Asked for comment, the West Point public affairs office told The Epoch Times in an emailed statement: “The U.S. Military Academy does not comment on pending litigation.”

On its website, West Point says that its Military Equal Opportunity (MEO) program "formulates, directs, and sustains a comprehensive effort to maximize human potential and to ensure fair treatment for all soldiers based solely on merit, performance, and potential in support of readiness. MEO philosophy is based on fairness, justice, and equity."

West Point pledges to "ensure equal opportunity and fair treatment for all cadets, soldiers, and family members, without regard to race, color, religion, national origin, sex (gender identity), or sexual orientation and provide an environment free of unlawful discrimination and offensive behavior. "

This comes amid a broader critique that the quality of America's warfighters is being undermined by policies and actions that generally fall under the umbrella of "woke."

The Rise of 'Wokeness'

The rise of "wokeness" in the military has been the subject of increased scrutiny and criticism, with a Navy training video instructing sailors how to use personal pronouns in line with the latest progressive norms so as to create a "safe space for everybody" being one example of that has irked many on the right who insist the military's focus should be on competence and readiness—not pronouns.

Recently, General Mark Milley, chairman of the Joint Chiefs of Staff, denied in an interview on CNN that the U.S. military had become "too woke."

After admitting that he's "not even sure what that word truly means," he said that America's military is "exceptionally strong."

"It's powerful. It's ready. In fact, our readiness rate is—the way we measure readiness—is better now than they've been in years," he added.

"This military is a lot of things but woke it is not," Mr. Milley said.

However, Mr. Milley acknowledged that there are "some things out there" that "could be fit into that category," referring to "woke."

"But I don't think it certainly is—it is not a broad-brush description of the U.S. military as it exists today," he added.

But some—perhaps even many—would disagree.

"Wokeness in the military has become ingrained," wrote Thomas Spoehr, director of the Center for National Defense at the Heritage Foundation, in an op-ed for The Epoch Times.

"Wokeness in the military is being imposed by elected and appointed leaders in the White House, Congress, and the Pentagon who have little understanding of the purpose, character, traditions, and requirements of the institution they are trying to change," Mr. Spoehr argued.

After listing various ideological policies that have been adopted by the U.S. military, including indoctrinating service members in critical race theory—he said

"The bottom line is that precious time and money are being poured into woke programs and projects that would be better applied toward making the military more capable," he argued.

Florida Gov. Ron DeSantis, who's seeking the Republican nomination for president in 2024, recently flagged the issue as a significant problem and vowed to "rip the woke out of the military and return it to its core mission."

The United Auto Workers have begun to strike all three of the major domestic automobile producers. They are seeking a 40% wage increase and other increases in benefits as well as a 32-hour work week. This is not only ridiculous, but it will severely hurt consumers and much of the rest of the economy.

If granted, the labor cost would increase by 60% by the fourth year. This would considerably drive up the price of cars. It will also hurt the workers since the high labor cost would encourage manufacturers to switch production to a more capital-intensive process by further automating.

The United Auto Workers (UAW) argues that inflation is up significantly. Although the inflation rate has fallen, last year it peaked at 9.1%  Union members say inflation could increase in the future, so a cost-of-living increase is needed.

The auto manufacturers have been very profitable. The latest available industry figures show car makers earned $32 billion in the first nine months of last year. Although there were struggles mostly due to supply chain issues, consumer demand was so high that, at one point, cars were selling for thousands above manufacturer's suggested retail price (MSRP).

Shawn Fain, president of the UAW said, “Record profits mean record contracts.” According to the UAW web page here are members' demands:

ELIMINATE TIERS – It’s wrong to make any worker second class. Teamsters ended tiers at UPS.

SUBSTANTIAL WAGE INCREASES – 40 percent over the next four years.

RESTORE COLA – Cost of Living Adjustments (COLA)

DEFINED BENEFIT PENSION FOR ALL WORKERS – All workers deserve the retirement security.

RE-ESTABLISH RETIREE MEDICAL BENEFITS – That’s just as essential as a solid pension.

RIGHT TO STRIKE OVER PLANT CLOSURES – Big Three closed 65 plants over the last 20 years.

WORKING FAMILY PROTECTION PROGRAM – keeps UAW members on the job.

END ABUSE OF TEMP WORKERS – We are going to end the abuse of temps.

MORE PAID TIME OFF TO BE WITH FAMILIES – Our members are working 60, 70, even 80 hours a week and it needs to stop.

SIGNIFICANTLY INCREASE RETIREE PAY – We owe our retirees everything. They built these companies, and they built our union. We will not forget them in these negotiations.

This list is ridiculous.

The UAW’s logic is like the logic used by the UPS workers and the Screen Actors Guild. Those workers believe that they are entitled to some of the company profits, especially when those profits are large.

In a free-market economy, though, they are not entitled to any profit. Nor, of course, are they expected to give some of their salary back if the company should have losses.

And that explains the difference in profit distribution between stockholders and workers. The difference is based on risk.

As long as the company is manufacturing cars, the workers are contractually guaranteed their wages. If the demand for cars is low, then the company must drop the price to sell the cars. They could incur losses.

Although the wage is guaranteed to the worker, the profit is not guaranteed to the stockholder who has invested capital in the corporation. The stockholder only gets a return when there are profits.

If there is no profit, there is no return. If the company has large losses, then it is possible they file bankruptcy (General Motors in 2009). In that case, the stockholder not only doesn’t get any return, but the value of the stock becomes zero, so they lost their entire investment.

The stockholders take all the risk. Some years profits are high, other years not, yet the workers continue to receive their contracted wage. The workers take very little, if any, risk.

Successful corporations know that for any business to achieve long-term success, having a strong mutually beneficial relationship with their employees is critical. Successful corporations also know that they must be profitable, or they will not be able to attract new capital for expansion.

Somewhere between that, the UAW and the car companies will find a compromise position, where labor is paid a wage that reflects their value to the production process and allows a fair long-term profit for stockholders.

The UAW’s current demands read like a three-year old’s Christmas list to Santa. “I want everything. Everything that’s in your big, big bag.”
