The “Search for One Honest Judge” Begins in Pasco County, FL



NEW PORT RICHEY, FL. The creator of the “Do It Yourself Ballot Challenge Kit” has just filed suit in Pasco County, Florida, Circuit Court against Barack Obama and the members of the State Executive Committee of the Florida Democratic Party, asking the court to keep Obama off the Florida ballot for the November 2012 general election. Pasco County resident Jerry Collette, noted legal strategist, developer of this brand new ballot challenge kit, and the plaintiff in the suit, says this is just the first in a Florida-wide and nationwide series of suits being organized, in Florida, by the Florida Ballot Challenge project, and nationally, by the Obama State Ballot Challenge project.

The ballot challengers say that they are on a quest to find one honest judge who will actually rule on the real constitutional issues in their cases rather than sweep the cases under the rug on some kind of procedural grounds. Iconic public interest attorney Larry Klayman came up with an idea to find the “one judge who can save America” and give an honest hearing to the issues surrounding Obama’s eligibility. Collette’s “Do It Yourself Ballot Challenge Kit” is a way for individuals all over the country to file their own ballot challenge lawsuits to help the ballot challengers find their one honest judge.

The suit itself claims that Obama is not qualified to be President because he is not a natural born citizen, as required by the U.S. Constitution. The suit is based upon two key issues: the uncertainty that still surrounds Obama’s birth certificate, and the fact that Obama’s father was not a U.S. citizen.

To this day, no original documentation of Obama’s birth, either from the government or the hospital, has yet been made public. On April 27, 2011, Obama posted what he claimed was a copy of his long form Hawaii birth certificate on the Internet. However, on March 1, 2012, Sheriff Joe Arpaio of Maricopa County, Arizona, released a report of an extensive investigation stating that there was “probable cause” that the Hawaii birth certificate Obama posted on the Internet was a “fraud.” Sam Sewell, Director of the Florida Ballot Challenge project, stated, “Bara
ck Obama promised us the most transparent administration in history, yet he has spent huge sums of money keeping his original birth documents hidden. If he wants to get on the ballot in Florida again, those documents simply need to be made public so this issue can be put to rest, once and for all.”

In addition to the birth certificate issue, the suit states that Obama’s father was not a U.S. citizen, a fact that does not seem to be in dispute. That fact, according to Pamela Barnett, a retired U.S. Army captain and National Director of the Obama State Ballot Challenge project, makes Obama only a native born citizen, at best, but not a natural born citizen, as required by the U.S. Constitution. Barnett said, “We have over 400 years of law, going all the way back to 1608, clearly showing what a natural born citizen is. No matter where he was born, Bara
ck Obama is not a natural born citizen.”

These issues have been repeatedly brought in lawsuits all over the country for the past four
years. Still, no original documentation of Obama's birth records has ever been examined by a court. Collette and his fellow ballot challengers believe that this case is different. Collette says he has a whole new legal strategy that has not been utilized before or elsewhere.

Collette admitted that
some judges will still not want to deal with these eligibility challenges, and will find creative, and even dishonest, ways to skirt the issues and dismiss the cases. That, said Collette, is why he created his “Do It Yourself Ballot Challenge Kit.” Sewell added, “If we file enough suits around state and around the country, eventually, we will find one honest judge who will examine the evidence in this crucial constitutional matter.”

Sewell referred to an article he wrote in which he stated: “An analysis of several national polls on the subject of AKA Barack Obama’s eligibility shows that about half the citizens in American are unsure or don’t believe that he is eligible to be President. It makes sense that Obama supporters would want the issue settled along with everyone else. I would conclude that those opposed to releasing all of Obama’s history are frightened of the truth just like AKA Barack Obama.” He then pointed out that President Obama himself said, in one of his weekly televised address to the nation in 2010, "The only people who don't want to disclose the truth are people with something to hide."

When asked if this had anything to do with Obama’s race, Sewell pointed out that, in 1991, Collette served, without pay, as manager of Richard Boddie’s campaign to be the Libertarian Party candidate for President. Boddie is African American.

Both Sewell and Collette stressed that this case was about the Constitution, not just about Obama. They said that if Marco Rubio or Bobby Jindal were to try to run for President or Vice President, the same eligibility issue would apply to them because, although there did not seem to be any unresolved issues about either Rubio’s or Jindal’s place of birth, neither is born of two American parents.
