Supplemental Brief Filed in Florida Ballot Challenge Case
Jerry Collette, plaintiff in the Pasco County Florida ballot challenge case against Barack Obama, has just filed a supplemental brief in opposition to the motions to dismiss, which were filed by Obama and the State Executive Committee of the Florida Democratic Party. According to Collette, he did not raise any new issues in his latest supplemental brief. Collette said, “I simply connected some of the dots that seemed obvious to me, but which other people who commented on my case did not seem to understand easily.”
The supplemental brief covers several points, such as Collette’s right to bring the action and that he is claiming an implied right. In his complaint, Collette claims that the eligibility requirements for federal office, by implication, give all citizens the right to not be governed by anybody who does not meet them. Collette said, “Courts have historically recognized implied rights. Roe v. Wade is probably the most famous case to do so.” Sam Sewell, Director of the Florida Ballot Challenge commented, “It doesn’t take any great stretch of logic to apply similar reasoning to the eligibility requirements.”
Collette is a paralegal and the creator of the “Do It Yourself Ballot Challenge Kit.” He is handling his case “pro se” (without an attorney).
The case is Collette v. Obama, case number: 512012CA 2041WS. The next hearing is scheduled for July 10, 2012, at 3:30 pm at the West Pasco Judicial Center in New Port Richey FL.
